Free Consultation and Estimate Policies

We do not bill potential clients for initial consultation
(via email or phone) in which we discuss your project and needs.
We would be happy to provide a free quote, valid for thirty (30) days. After
30 days, all quotes will become null and void and a new quote must be requested.
Non-disclosure Policy
- We acknowledge and agree that any and all source materials,
technical and/or marketing plans, or other sensitive business materials supplied by
to us by clients and potential clients are considered confidential information and shall
not be disclosed to any third party.
Website Development & Graphic Design Policies
- A deposit (generally 50% or as mutually agreed) is due before work commences.
Work will commence within 24-48 hours of receipt of said deposit.
- Once work has commenced, the deposit is non-refundable, with exception of special
circumstances upon mutual agreement.
- Balance of payment is not due until the design process is complete.
- When the site is complete the client shall still have 30 days to review the site for
errors or text revisions to the existing content. This does not include wholesale
changes to the content of any entire page, but is our assurance that any errors,
ommissions, etc shall be repaired at no additional cost.
- If, at any time during the design process, you become unreachable for an extended
period of time, or fail to respond to email or phone communication for a period of 10
days or more, and do not notify us in advance of your absence, your site may be placed
on hold and work may commence on the next client.
In this event, when you do return, we will reschedule the time frame for completion
depending on any new work commenced during your absense. Good communication is vital,
and we are very flexible as long as good communication is maintained.
- Clients must not access their web files during the design process as this can
result in errors or unintended file deletions and may involve repair fees. Once
design work has been completed and approved, and final payment has been received,
clients may access their site files as desired and at their discretion if they wish
to do so.
Acceptable Use Policies
- No persons may use BengalMarketing.com facilities, services, products or capabilities
to conduct, or solicit the performance of, any illegal activity, or to conduct any
other activity which infringes on the rights of BengalMarketing.com or any third party.
- No client may upload, submit for use in design or otherwise transmit any message,
data, image or program that would violate the property rights of any third party.
This includes the unauthorized transmission of copyrighted text, images, music,
programs, or trade secrets or other confidential proprietary information,
trademarks, service marks or trade names used in an infringing manner.
Customers may not upload or transmit any information which is libelous or
defamatory, or which violates or infringes on any right of privacy of any person.
Refusal of service
- We reserve the right to refuse service to anyone at our sole discretion.
Indemnification
Client agrees to defend, indemnify, save and hold BengalMarketing.com harmless from any and
all demands, liabilities, losses, costs and claims, including reasonable attorneys
fees asserted against BengalMarketing.com, its agents, its customers, officers and employees
that may arise or result from any service provided or performed or agreed to be performed
or any product sold by the client, its agents, employees or assigns. Client agrees to
defend, indemnify and hold BengalMarketing.com harmless against liabilities arising
out of; (1) any injury to person or property caused by any products sold or otherwise
distributed (2) any material supplied by customer infringing or allegedly infringing on
the proprietary rights of a third party; (3) copyright infringement.
(With humble apology to those of the legal profession... in plain English, this means that
if your product or service causes harm to any third party, having developed your website
or assisting with promotion does not make us liable. If you send us information to post
to your website and it turns out to be a copyright infringement, we are not responsible.)

disclaims any warranty or merchant ability or fitness for a particular purpose.
Additionally, we reserve the right to revise our policies at any time.

Information sent via email website contact form is used only to allow us to respond to you.
This information is never distributed to third parties and you will not be added to a
mailing list.
Customer Information;
When you purchase products or services, you may be required to submit personal information.
This information will not be shared, distributed or used in any way except to process
your order and to communicate with you from time to time.
Online Security;
Whenever you provide any confidential information, such as credit card
information, we use SSL technology to provide data encryption for your protection
and security.
Cookies;
When it comes to cookies, we prefer ours warm from the oven. We do not utilize cookies
or any similar technology to collect or store information about our website visitors.
Email Lists;
We reserve the right to maintain a private and confidential mailing list containing
email contact information for our clients. This allows us the ability to contact clients
regarding ongoing projects and/or other items of interest.
Rest assured we do not use or endorse the use of unsolicited bulk email or unsolicited
commercial email. Your email address will be kept private and will never be distributed
for any reason whatsoever.
